O presente trabalho visa analisar dois pensamentos distintos sobre a Ciência do Direito, principalmente a contar do século XIX com o positivismo jurídico, e, atualmente, trazer uma abordagem crítica sobre a Ciência jurídica.

This article studies the traditional economic, political and religious alienation in Brazilian society. This retrospective study will analyze the causes and consequences of this alienation, from colonial times until the mid-twentieth century. It was only in the 1940's that Brazilian people began, slowly, to have a voice in the decision taking processes that affected their fate. Brazilian society was established under the aegis of Catholicism, the official religion of the State until 1891, and was ruled by an elite that dominated (...) the economic, political and religious spheres, controlling all the means that were necessary to keep them in power. The underprivileged majority, without any political participation, lived on the crumbs within the acceptable limits for the elite. This process was methodical and systematic. In the mid-twentieth century, for reasons that will be discussed in this article, there was a brief but intense popular interest in taking control of their own fate. This phenomenon was soon aborted by the historical happenings that marked the 1960’s. This study will focus in pondering: is there really a possibility of change in the Brazilian society or is it an unachievable utopia? (shrink)

RESUMO Trabalhar o tema da amizade a partir de textos de Hume e Kant, no âmbito do debate do Iluminismo constitui o objeto deste trabalho. O Iluminismoé o período em que o desejo de esclarecimento e a atitude crítica têm seu ápice, na racionalidade moderna. A partir do espaço constituído pela amizade, da imbricação do Iluminismo como lugar de produção e profissão da verdade e da moral, esse trabalho questiona: Quais eram as relações entre a amizade e esclarecimento nesses textos (...) do Iluminismo? De que forma essa amizade atravessava a governamentalidade do século XVIII e imbricava no governo dos indivíduos? A análise dos textos indica a constituição de uma forma peculiar de amizade que funcionava como tecnologia e estratégia de esclarecimento dos indivíduos, e consequentemente na gestão de outros aspectos, em favor de uma "governamentalidade moderna" que buscava agir tanto no nível individual, do corpo, quanto no nível populacional, da vida. Mais que retrato fiel do século XVIII, do Iluminismo ou da Amizade, esse trabalho experimenta traçar mapas de intensidade para que se possa utilizar desse escrito como aparato de ação e pensamento, ativo e criativo. As referências a Nietzsche proliferam de tal forma ao longo dos quase trinta anos de produçáo teórica de Foucault que fica evidente o forte elo que há entre ambos. Além disso, um exame atento das análises foucaultianas sobre a emergência de um saber sobre o indivíduo na modernidade revela que existem, do ponto de vista programático, afinidades consistentes. No entanto, deixar de levar em conta eventuais dissonâncias ou mesmo antagonismos resulta, ao mesmo tempo, numa abordagem superficial e incompleta. As muitas verdades sobre a infância de nosso tempo, das mais catedráticas às mais “inovadoras”, encontram-se compiladas em livros e artigos dentro e fora de nossas bibliotecas. Grosso modo, elas constroem dois tipos de niilismo. Um niilismo de tipo universalista, que suga a criança para fora da imanência da vida e da histórica e a torna refém de estereótipos universais. Outro niilismo de tipo relativista, que esquece a criança e apenas acusa os estudos da infância como mera invenção. Evitar esses (...) extremos requer uma espécie de arte acrobática de equilibrar-se na possibilidade de um entre. Essa via busca retomar a imanência histórica da criança. Trata-se de uma pesquisa em busca da potencialização da ideia de invenção cuja atitude crítica implicasse não a pergunta pelo governo certo ou pela ausência de governo da infância, mas como não a governar assim, por essas pessoas, em nome destes princípios, em vista de tais objetivos e por meio de tais procedimentos. In this paper I intend to consider the various inflexions through which passes the Nietzschean concept of genealogy in Michel Foucault’s work throughout the 1970s and 1980s. I wish to point out that the genealogical procedure is modified according to the addressed subject, i.e. it does not share the same theoretical and methodological assumptions when it is focusing the rejection of the metaphysical notion of an essential origin; the relationship of reciprocity between Knowledge and Power; the project of transforming human (...) life into a sort of work of art and, finally, the developing of an idea of truth divorced from logical, epistemological or ontological parameters. A reflexão ética em Nietzsche possui diversos objetivos: a dissecação psicológica das contradições da moralidade de rebanho ; a fidelidade ao que cada um tem de singular ; o antagonismo entre “senhores” e “escravos” ; a afirmação incondicional do eterno retorno ; o imperativo de autossuperação trágica. A problematização foucaultiana da conduta individual, por sua vez, abrange a cultura greco-romana no intuito de formular as bases do que seria uma “vida bela”. Essa postura tem por objetivo circunscrever todo um conjunto (...) de “tecnologias de si” que permitam a invenção de modalidades inovadoras de governo de si e dos outros na modernidade. Apesar da especificidade do projeto filosófico de cada um, os dois autores possuem, como denominador comum, o imperativo de promover uma existência artística. (shrink)

This study assesses the retractions of scientific articles in engineering journals indexed on the Web of Science from 1945 to 2015. The data set was built based on documents containing the keywords retracted, retraction, withdrawal, or redress. We used database exploration techniques, including Structured Query Language and analysis of variance, for data analysis. We analyzed 238 retractions published by 117 journals. The most common reason for retraction was unethical research, and higher impact factors journals tended to publish more retractions. This study aimed to outline the profile of retractions of scientific articles on COVID-19 published in journals indexed in the Scopus database between 2020 and 2021. To analyze the data, we used a bibliometric technique, with the Bibliometrix package in the R-Studio software, and descriptive statistics. Twenty-nine retractions were analyzed, and we found that the most common reasons for retraction were related to ethical issues and that 68.97% of authors have previously retracted articles. We concluded that there appears to have (...) been a change in the publication policies of journals, which resulted in an increase in scientific retractions related to COVID-19 during the study period. Ludwig Boltzmann is one of the foremost responsible for the development of modern atomism in thermodynamics. His proposition was revolutionary not only because it brought a new vision for Thermodynamics, merging a statistical approach with Newtonian physics, but also because he produced an entirely new perspective on the way of thinking about and describing physical phenomena. Boltzmann dared to flirt with constructivism and realism simultaneously, by hypothesizing the reality of atoms and claiming an inherent probabilistic nature related to many (...) particles systems. Boltzmann faced criticism from the positivists, who rejected the hypothesis of the atom as a matter of principle, and also from physicists, who rejected the idea of a classical bounded system that does not follow deterministic mechanical laws. We consider that Boltzmann thermodynamics has emerged as a systemic theory that deals with macroscopic bodies using collective variables; it was reformulated to a kinetic theory of gases, and subsequently to statistical mechanics. From the theoretical physical point of view, Boltzmann advocates an approach to thermodynamics based on mechanics and was one of the founders of statistical mechanics, together with ideas by Maxwell, Clausius and Gibbs. Subsequently, statistical mechanics has also influenced the development of quantum mechanics and information theory. Using an evolutionary epistemological perspective as a metaphor to describe the physical entities claimed in Boltzmann propositions, we interpret his work as a selected theory that gained attributes of reality and “survived” during a scientific-contextual competition to be more adapted, in the sense that it was able to better explain physical phenomena, and also generated “descendants”. The aim of this paper is analysis the myth in Plato’s work based on the paper of Ludwig Edelstein. In his work, Edelstein presents to us the reason why Plato uses the myth and the function it plays in his philosophy. The author thus contributes to the development of thought on the subject and provides a lever for later studies on the myth in Plato. Finally, we will present a critical conclusion on the subject.

O presente artigo busca apresentar a concepção de essência humana materialista antropológica de Feuerbach. Ao longo de seu pensamento, Feuerbach, procura esclarecer que pensar o homem, significa pensá-lo dentro dos limites da condição humana material sensível e física. Portanto é enfatizado que Feuerbach sustenta que o acesso a nossa essência está relacionado com a maneira como acessamos a nossa consciência e que a maneira como acessamos essa última tem uma condição estritamente material e, portanto, deveríamos abordá-la exatamente dessa maneira e (...) não como algo fora de nós e meramente abstrato como a filosofia especulativa. A essência humana não alienada é resultado de uma relação adequada do ser humano com aqueles atributos que são estritamente humanos, que são razão, vontade e coração. Por fim, pretende-se apresentar como Feuerbach compreende a essência humana e qual deve ser a condição para o contato de forma não alienada do homem com a mesma, bem como o que é necessário para possibilitar tal contato. This paper takes the vigorous political debate unleashed in Germany by the results of the PISA study as a stimulus to take a closer look at the strategic aims and effects of the current education reforms, of which the PISA study is only one example. It shows that the reform measures underpin a powerful process of normalisation. In this context, the PISA study, along with other reform measures, can be seen as a ‘power stabiliser’. The paper indicates how techniques of (...) political domination are linked with ‘technologies of the self’ and how the ‘discourse of self organization’ can be seen as the core of a governmental strategy to assimilate education more thoroughly than ever before into a network of disciplinary procedures and ‘voluntary self‐control’. O objetivo deste artigo é analisar o conceito de vivência (Erlebnis) na filosofia de Nietzsche, desde o seu primeiro emprego em língua alemã, seu significado e a recepção que Nietzsche faz da palavra no interior da sua filosofia. O conceito de Erlebnis, particularmente caro à filosofia de Nietzsche, mas também à fenomenologia, possui originariamente uma tríplice significação: a) a imediatez (Unmittelbarkeit) entre homem e mundo; b) a significabilidade (Bedeutsamkeit) para o caráter global da existência; e c) a incomensurabilidade (Inkommensurabilität) do (...) conteúdo da própria vivência, conferindo a ela também uma dimensão estética. A tríplice significação de Erlebnis implica na sua estreita associação a pathos. This paper aims to analyze the concept of experience (Erlebnis) in the Nietzsche's philosophy, since its first use into the German language, its meaning and reception of Nietzsche inside his philosophy. The concept of Erlebnis, especially dear to the philosophy of Nietzsche, but also to phenomenology, originally has a triple meaning: a) the immediacy (Unmittelbarkeit) between man and world, b) meaningfulness (Bedeutsamkeit) to the global nature of existence and c) incommensurability (Inkommensurabilität) of the experience's content itself, giving it also an aesthetic dimension. The threefold meaning of Erlebnis implies its close association with pathos. (shrink)

It is first Kant who makes "practical reason" a central term in moral philosophy. He departs from a tradition which assigned clearly distinct roles within the theory of moral obligation to "ratio" on the one hand, and "voluntas" on the other. Using an example of a Christian natural law approach employed before Kant, the article isolates and portrays each of these roles. Against this background it shows that Kant transforms a theological argument for God's self-obligation though His own will to (...) create a "kingdom of nature" into a philosophical argument for human self-obligation through human creation of a "kingdom of freedom". The rational and voluntary moments of this "act of creation" are expressed in the concept of "practical reason". This concept thus articulates human understanding of self as a self-legislating and free being. 'Praktische Vernunft' wird erst mit Kant zu einem zentralen Terminus der Moral. Er steht quer zu jener Tradition, welche bis dahin der 'ratio' einerseits und der 'voluntas' andererseits wohlunterschiedene Aufgaben im Rahmen der Theorie moralischer Verbindlichkeit zuwies. Am Beispiel einer christlich-naturrechtlichen Argumentationsweise vor Kant werden die beiden genannten Aufgaben herausgearbeitet. Es zeigt sich vor diesem Hintergrund, daß Kant ein theologisches Argument für die Selbstbindung Gottes durch dessen eigenen Willen zur Schöpfung eines 'Reiches der Natur' in das philosophische Argument einer Selbstbindung des Menschen durch die Schöpfung eines 'Reiches der Freiheit' transformiert. Vernunft- und Willensmoment ebendieses 'Schöpfungsaktes' finden Ausdruck in dem Begriff einer 'praktischen Vernunft'. Dieser artikuliert somit das Selbstverständnis des Menschen als eines sich selbst das Gesetz gebenden, freien Wesens. (shrink)

A contradição é um conceito central para que se compreenda o desenvolvimento dialético da filosofia de Hegel. Desde a Antiguidade é debatido pelos filósofos se a contradição seria ou não uma anomalia a ser combatida quando se pensa na possibilidade da constituição de um discurso acerca das coisas e qual o seu alcance. No que se refere a Hegel, a contradição não está presente apenas no domínio dos conceitos, mas também na natureza. O que pretendemos aqui é apreender o significado (...) dessa contradição na natureza e do conceito de movimento que dela deriva. Para tanto, primeiro acompanharemos certos aspectos dessa temática no debate de Hegel com alguns autores da Antiguidade e a seguir trataremos da exposição hegeliana do mesmo tema na Filosofia da Natureza da Enciclopédia a partir da dedução do conceito de tempo. The contradiction is a central concept in order to understand the dialectical development of Hegel's philosophy. Since ancient times is debated by philosophers if the contradiction would or wouldn’t be an anomaly to be fought when considering the possibility of setting up a speech about things and what its scope is. With regard to Hegel, the contradiction is not only present in the field of concepts, but also in the nature. What we intend here is to grasp the significance of this contradiction in the nature and the concept of movement derived from it. For this, first we will follow certain aspects of this theme in Hegel’s discussion with some authors of antiquity and then dealing with the hegelian exposition of the same theme in the Philosophy of Nature of the Encyclopaedia from the deduction of the concept of time. A experimentação de técnicas de risco na preparação do ator e na construção do texto espetacular se orienta à criação de cerimônias teatrais cujo eixo é a constituição de novos vínculos entre a audiência e a performance.

Die Rede von dem Konstruktivismus legt auf den ersten Blick die Vermutung nahe, es handele sich dabei um ein konsistentes, klar umrissenes Theoriegebäude. Doch wird auf den zweiten Blick schnell deutlich, dass ein ganzes Bündel von Referenztheorien zum Verständnis des Konstruktivismus in Betracht gezogen werden muss: etwa Evolutionstheorie, Neurobiologie, Kognitionstheorie, Kybernetik und Systemtheorie, um nur einige zu nennen. Es liegt auf der Hand, dass es den Konstruktivismus so nicht gibt.

Neste artigo, proponho uma leitura do ensaio de Hannah Arendt "A crise na educação" que o apreenda como um exercício de pensar. Assim, os problemas, argumentos, conceitos, das quatro seções do ensaio serão examinados como constitutivos de um movimento argumentativo cujo ponto de partida são aspectos particulares de uma crise na educação em direção às suas causas gerais e mais profundas, oriundas da crise da Modernidade.

Excerpt from Philosophische Stromungen der Gegenwart Der Kampf um einen neuen Lebensinhalt ist wieder einmal entbrannt. Es gahrt in den Kopfen. Man verlangt, wie zu allen Zeiten, da das Leben aufwarts ging, von der Philosophie Antworten auf jene Ratselfragen, deren Losung einst der Theologie uberantwortet wurde, wahrend man sie zuletzt der Naturwissenschaft anheimgestellt hat. Da weder die Deutungen der Theologen, noch die Erklarungen der Naturforscher endgultig zu befriedigen vermogen, so klopft man aufs neue bei den Philosophen an. Mit dem 20. (...) Jahrhundert hat eine philosophische Bewegung eingesetzt, die zu einer Neublute der einst verfemten "Naturphilosophie" gefuhrt hat. Die "philosophischen Stromungen der Gegenwart" gilt es hier festzuhalten. In der atemlosen Hast und verwirrenden Unrast der philosophischen Gedankenbildungen unserer Tage laufen wir Gefahr, aneinander vorbei zu philosophieren. Es durfte daher geboten sein, von Zeit zu Zeit Atem zu holen und Umschau zu halten. Selbstbesinnung und Selbstbescheidung fordern gleichsehr geschichtlichen Umblick und systematischen Ausblick.
